1. Agreement to Terms

Welcome to FableForge, a product of Forgeworks Labs PTY LTD ("Forgeworks Labs", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the FableForge website and our AI-powered interactive role-playing game platform (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and acknowledge that you have read and understood our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

1.1 Minimum age

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old and have the legal capacity (or, where required, the involvement of a parent or legal guardian) to enter into these Terms. If you are between 13 and 17, you agree to use the Service only with the involvement of a parent or guardian where required by your jurisdiction.

If you are accessing the Service from the European Economic Area, the United Kingdom, or any other jurisdiction where the digital age of consent is above 13, you must be at least 16 years of age to use the Service.

1.2 Mature content

Some features of the Service contain mature content, including descriptive depictions of violence, sexuality, horror, vulgarity, and other adult themes. Mature content is disabled by default and is accessible only after an explicit per-account opt-in.

To enable the mature-content option, you must self-attest that you are at least 18 years of age and legally permitted to view such content in your jurisdiction. Where the local age of majority is higher than 18, that higher age applies to you.


2. Description of Service

FableForge is an AI-powered platform for playing interactive role-playing game experiences. The Service features real game mechanics including tactical combat, character progression, inventory management, quests, and AI-generated narration that brings gameplay to life.

The Service allows users to:
- Play through curated game experiences ("Experiences") set within themed worlds ("Universes")
- Create and customise characters with meaningful abilities and progression
- Engage in gameplay powered by a combination of structured game systems and AI narration
- Share stories and experiences with the community

In future phases, the Service may allow users to create their own Universes and Experiences for others to play.


3. Service Phases and Availability

The Service is currently in active development and will progress through multiple phases:

  • Preview Phase: Users may explore information about available Universes and Experiences. Gameplay features may be limited or unavailable.
  • Early Access Phase: Users may play available Experiences and provide feedback. Features are experimental and subject to change.
  • Creator Tools Phase: Users may access tools to create their own Universes and Experiences. Creator Tools remain subject to Early Access conditions and may change significantly.
  • Full Launch: The Service becomes publicly available with stable features.

You acknowledge and agree that:
- The Service is provided on an "as-is" and "as-available" basis during all phases
- Features may be added, modified, or removed at any time without notice
- The Service may be unavailable during maintenance or updates
- Data from earlier phases may not carry forward to later phases, though we will avoid data resets where reasonably possible
- Your feedback during early phases may be used to improve the Service


4. Artificial Intelligence and Content Disclaimer

The Service uses artificial intelligence provided by third-party partners to generate narrative content, dialogue, and game responses. You acknowledge and agree that:

  • AI-generated content is created for entertainment and gameplay purposes only
  • All content produced by the Service is entirely fictional and does not represent real people, events, places, or factual information
  • AI technology is experimental and may produce unexpected, inaccurate, or inappropriate content despite our safeguards
  • You should not rely on any AI-generated content for medical, legal, financial, psychological, or any other professional advice
  • Engaging with any content, including mature themes, is entirely at your own discretion and risk
  • While we endeavour to keep AI interactions within the game context, we cannot guarantee complete enforcement

We are not liable for any AI-generated content, including any errors, inaccuracies, or offensive material that may be produced.


5. AI Training and Model Use

5.1 Use of inputs and outputs to operate and improve the Service

We may use the prompts you provide and the AI-generated outputs returned to you to operate, maintain, evaluate, debug, and improve the Service and our underlying AI systems, including training and tuning AI models. Where we offer settings to opt out of model training in respect of your data, those settings will govern.

5.2 No training of competing AI systems

You may not use outputs of the Service — whether AI-generated narration, dialogue, NPC behaviour, or other generated content — to train, fine-tune, evaluate, or otherwise develop any AI model or service that competes with the Service or with our AI providers' services.

5.3 No guarantee of uniqueness

The Service generates content procedurally and probabilistically. The same or substantially similar AI-generated content may be produced for other users. We make no representation that any AI-generated output is unique to you.


6. User Accounts

To access most features of the Service, you must register for an account. Account services are provided through Clerk, a third-party authentication provider.

You agree to:
- Provide accurate and complete information during registration
- Maintain the security and confidentiality of your account credentials
- Not share your account credentials with any other person
- Accept responsibility for all activity that occurs under your account
- Notify us immediately if you believe your account has been compromised

We reserve the right to suspend or terminate accounts that violate these Terms, that we reasonably believe have been compromised, or where required for the safety of other users or for legal compliance.


7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Generate or attempt to generate sexual content depicting minors, including content that sexualises or eroticises persons under 18 in any frame — including fictional, fantasy-species, age-regression, retrospective, or any other displaced frame. We report apparent child sexual abuse material to the appropriate authorities.
  • Generate or attempt to generate operational instructions for real-world harm, including step-by-step synthesis routes for weapons, explosives, drugs, biological or chemical agents, or working exploit code targeting real systems
  • Generate content infringing the intellectual property rights of third parties, including copyrighted characters, trademarked properties, and likenesses of real persons. You are responsible for outputs you direct the Service to produce.
  • Use outputs of the Service to train, fine-tune, or evaluate any other AI model (see Section 5.2)
  • Harass, abuse, threaten, or harm other users
  • Impersonate any person or entity, or falsely represent your affiliation
  • Attempt to bypass, disable, or circumvent any security features or content filters
  • Use automated tools, bots, scrapers, or other means to access the Service without our permission
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Exploit bugs, glitches, or vulnerabilities for unfair advantage or to disrupt the Service
  • Abuse trial periods, promotional credits, or refund mechanisms through duplicate accounts, false claims, or other means
  • Resell, redistribute, or commercially exploit any part of the Service without our express written permission
  • Upload or transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the integrity or performance of the Service
  • Collect personal information about other users without their consent

We reserve the right to investigate and take appropriate action against anyone who violates these prohibitions, including removing content, suspending accounts, and reporting to law enforcement.


8. Intellectual Property Rights

Our Property

The Service, including its software, design, graphics, interfaces, game systems, proprietary Universes, characters, locations, lore, and all associated branding and trademarks, are the exclusive property of Forgeworks Labs and its licensors. All rights are reserved.

Your Gameplay Content

You retain ownership of the original creative inputs you provide during gameplay, such as character names and dialogue choices ("User Content"). By using the Service, you grant Forgeworks Labs a worldwide, non-exclusive, royalty-free licence to use, process, store, and reproduce your User Content solely for the purpose of operating and providing the Service to you.

AI-Generated Output

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, personal, revocable licence to use AI-generated content produced by the Service for your personal, non-commercial entertainment purposes. Commercial use of AI-generated content requires our express written permission.

Sharing and Marketing

If you publicly share stories, screenshots, or testimonials from your gameplay (on our platform, Discord, social media, or elsewhere), you grant us permission to use such shared content for marketing and promotional purposes. We will not use private in-game data for marketing without your explicit consent.

Creator Content (Future)

When creator tools become available, separate terms regarding ownership, licensing, and rights for creator-generated Universes and Experiences will be provided. We are committed to creator agency and empowerment, and will work to establish fair terms that support and reward creators for their contributions.


9. Intellectual Property Complaints

We respect the intellectual property rights of others and expect users to do the same.

If you believe that content on the Service infringes your copyright or other intellectual property rights, please submit a written notice to [email protected] containing:
- Your contact information
- A description of the work you claim has been infringed
- A description of where the allegedly infringing content is located on the Service
- A statement that you have a good faith belief that the use is not authorised
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or authorised to act on their behalf
- Your physical or electronic signature

We will investigate valid complaints and take appropriate action, which may include removing the content in question.

Repeat Infringers

We reserve the right to terminate the accounts of users who repeatedly infringe the intellectual property rights of others.


10. Payments and Subscriptions

The Service may offer virtual credits, subscription plans, or other paid features. Payment processing is handled by Stripe, a third-party payment processor, and is subject to Stripe's terms of service and privacy policy.

You acknowledge and agree that:
- All payment details are handled securely by our payment processor
- Virtual credits have no cash value and cannot be exchanged for money
- Pricing, credit amounts, and subscription terms may change at any time
- Refunds are provided only where required by applicable law, including the Australian Consumer Law
- Credits or subscription benefits may be lost if your account is suspended or terminated for violation of these Terms

10.1 Subscriptions and auto-renewal

Subscription plans renew automatically at the end of each billing period at the then-current price unless you cancel before renewal. You can cancel at any time through your account settings or by contacting us; cancellation takes effect at the end of the current billing period. We will provide reasonable notice of any material change to subscription pricing or terms before that change applies to your account.

10.2 Discretionary refunds for unused subscriptions

Where a subscription has auto-renewed for an account that shows no usage during the renewed period, we may issue a discretionary refund on request. This is in addition to any rights you have under the Australian Consumer Law or other applicable consumer protection laws.

Nothing in this Section excludes, restricts, or modifies any rights you may have under the Australian Consumer Law that cannot be lawfully excluded.


11. Data, Privacy, and Account Management

We are committed to protecting your privacy and giving you control over your data.

  • Your gameplay data is stored to provide and improve your experience
  • We do not manually review or analyse individual player data
  • We may explore opt-in programs for aggregated or anonymised data usage in the future
  • You may request deletion of your account and associated data at any time
  • We will retain data only as long as needed to provide the Service or as required by law
  • If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR). These rights are described in detail in our Privacy Policy

If you are a minor (between the digital age of consent in your jurisdiction and 17), additional privacy protections may apply under your local laws. Our Privacy Policy describes how we handle minors' data and how a parent or guardian may contact us.

12. Service Modifications and Data

We reserve the right to:
- Modify, update, or discontinue any feature of the Service at any time
- Reset or migrate data between service phases when necessary
- Suspend or terminate the Service or any part of it

We will make reasonable efforts to provide notice of significant changes where practicable. We are not liable for any modification, suspension, or discontinuation of the Service.

You are responsible for maintaining your own copies of any content you wish to preserve.


13. Termination

We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for any reason, including but not limited to violation of these Terms, conduct that we reasonably believe threatens the safety or wellbeing of other users, legal compliance obligations, or operational necessity.

You may terminate your account at any time through the Service settings or by contacting us.

Upon termination:
- Your right to use the Service ceases immediately
- You may lose access to any content, credits, or data associated with your account
- Provisions of these Terms that should reasonably survive termination will remain in effect, including intellectual property rights, disclaimers, limitations of liability, and dispute resolution

13.1 Re-registration following termination for breach

If your account is terminated for breach of these Terms, you may not register a new account using a different name, email address, or payment method, and we may detect and remove such accounts. This restriction does not apply to accounts terminated for inactivity, account-deletion requests, or technical or billing issues.


14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT

YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.


15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORGEWORKS LABS AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
- ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
- ANY CONTENT GENERATED BY THE AI OR PROVIDED BY OTHER USERS

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED AUSTRALIAN DOLLARS (AUD $100), WHICHEVER IS GREATER.

Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, right, or remedy implied or imposed by the Australian Consumer Law or any other applicable law that cannot be lawfully excluded or limited.


16. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Forgeworks Labs and its directors, employees, partners, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of any third party
- Any content you submit, share, or direct the Service to generate


17. Governing Law and Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.

17.1 Informal resolution first

Before initiating any formal dispute resolution proceeding, you agree to first contact us at [email protected] and make a good-faith effort to resolve the dispute informally. We will respond within thirty (30) days of receiving your notice. This requirement does not apply to claims for injunctive relief or to small-claims court matters.

17.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any disputes arising from these Terms or your use of the Service.

17.3 Individual basis

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action. This does not affect any rights you may have under the Australian Consumer Law or other applicable consumer protection laws.

If you are located in the European Economic Area (EEA) or the United Kingdom, nothing in this section limits your rights under the General Data Protection Regulation (GDPR) or prevents you from bringing a claim before the courts or data protection authority of your country of residence.


18. Electronic Communications

By using the Service, you consent to receiving electronic communications from us, including service announcements, account notifications, and updates. We maintain email communications in compliance with applicable opt-in laws (including the Australian Spam Act 2003 (Cth) and the EU ePrivacy Directive), and you may opt out of promotional communications at any time while continuing to receive essential account-related messages.


19. Changes to Terms

We may modify these Terms at any time. When we make changes, we will update the "Last Updated" date and version number at the top of this page.

For material changes, we will make reasonable efforts to provide notice through the Service or via email and will require you to re-acknowledge the updated Terms before continuing to use the Service. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you should stop using the Service.


20. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forgeworks Labs regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
  • Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.
  • No Agency: Nothing in these Terms creates any partnership, joint venture, or agency relationship between you and Forgeworks Labs.
  • Feedback: Any suggestions, ideas, bug reports, or other feedback you provide regarding the Service may be used by us without restriction or compensation. You assign to us all rights necessary to incorporate such feedback into the Service.
  • Export compliance: You may not access or use the Service from any country, or as any person, subject to U.S. or Australian export sanctions, embargoes, or trade restrictions, and you may not use the Service in connection with any sanctioned end-use. You represent that you are not on any restricted-party list maintained by the U.S. Office of Foreign Assets Control (OFAC), the Australian Department of Foreign Affairs and Trade (DFAT), or any equivalent authority.
